ESCALATOR PROVISION ON RISE IN PRODUCTION COSTS
In the event that the cost of production of the goods to seller for any month period during the term of this agreement shall increase [Percent Increase] % percent above the average cost of production of the goods for the preceding month period, seller shall have the right, on giving [Days of notice of increase] days written notice to buyer, to increase the price payable under this agreement for goods to be delivered after the expiration of such days in an amount not to exceed the actual increase in the cost of production to seller, provided that no more than one increase be made in any calendar year.
This is a UCC-buying and selling form.
It is intended to be an addendum to other forms.
